Terms of Service

Welcome to Elite Writers ("the Platform"), Kenya's premier freelance writing platform connecting professional writers with opportunities in academic, business, SEO, technical, and other writing fields.

By accessing or using the Platform, registering an account, or submitting payments (including the one-time registration fee), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

Elite Writers is operated as a marketplace facilitating connections between writers ("Writers" or "you") and internal job opportunities. We are not a direct employer but an intermediary platform.

1. Eligibility

• You must be at least 18 years old to use the Platform.
• You must be a resident of Kenya or eligible to receive payments via M-Pesa.
• You represent that all information provided during registration is accurate and complete.

2. Account Registration and Security

• To access writing jobs, you must register and pay a one-time registration fee of KSH 500 via M-Pesa STK Push upon submission of your registration form.
• This fee covers account activation, profile setup, and access to the writer portal. It is non-refundable once paid.
• You are responsible for maintaining the confidentiality of your account credentials.
• Notify us immediately of any unauthorized use of your account.

3. Writer Obligations

• All work submitted must be original, plagiarism-free, and created solely by you.
• You warrant that your submissions do not infringe any third-party intellectual property rights, including copyrights, trademarks, or privacy rights.
• Plagiarism or use of AI-generated content without disclosure is strictly prohibited and may result in immediate account termination, forfeiture of earnings, and potential legal action.
• You must meet deadlines and follow job instructions provided.
• You agree to revisions as reasonably requested for assigned jobs.

4. Payments and Withdrawals

• Earnings from completed jobs are credited to your Platform account.
• Withdrawals are processed via M-Pesa within 24 hours of request, subject to any minimum thresholds or verification.
• All payments (including the registration fee and withdrawals) are processed through Safaricom M-Pesa and subject to Safaricom's terms and any applicable fees.
• Elite Writers is not liable for delays or issues caused by M-Pesa services.
• Taxes: You are solely responsible for reporting and paying any taxes on your earnings as required by Kenyan law.

5. Platform Rules

• No direct contact with clients outside the Platform.
• No sharing of personal contact information that bypasses the Platform.
• Prohibited activities include: spam, harassment, fraudulent submissions, or any illegal activity.
• We reserve the right to suspend or terminate accounts for violations of these Terms.

6. Intellectual Property

Upon completion and payment for a job, all rights to the work transfer to Elite Writers or the end client.

You grant Elite Writers a perpetual license to use your profile and samples for promotional purposes.

7. Data Protection and Privacy

• We comply with the Kenya Data Protection Act, 2019.
• Your personal data (name, email, phone, etc.) is collected for account management, payments, and communication.
• We do not sell your data to third parties.
• Data may be shared with payment processors (e.g., Safaricom for M-Pesa) as necessary.
• You have rights to access, correct, or delete your data—contact us at support@elitewriters.co.ke.

8. Disclaimers and Limitation of Liability

• The Platform is provided "as is" without warranties of any kind.
• Elite Writers is not liable for any indirect, incidental, or consequential damages arising from use of the Platform.
• Our total liability shall not exceed the amount of fees paid by you in the last 12 months.
• We are not responsible for job availability or client actions.

9. Termination

• You may terminate your account at any time.
• We may terminate or suspend your account for breach of these Terms, with or without notice.
• Upon termination, unpaid earnings may be forfeited if due to violations.

10. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved in the courts of Kenya.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform constitutes acceptance of changes. Significant changes will be notified via email or Platform announcement.
